HomeMy WebLinkAboutResolution-1989-1180 HESOLUTION NO. 1180 TITLE: A RESOLUTION SETTING A SPECIAL ELECTION FOR APPROVAL OF A FRANCHISE AGREEMENT BETWEEN THE CITY OF WHEAT RIDGE AND PUBLIC SERVICE COMPANY FOR FEBRUARY 13, 1990. WHEREAS, Section 15.6 of the Home Rule Charter of the City of Wheat Ridge allows the granting of a Franchise upon approval thereof by a majority of the Wheat Ridge Electors voting thereon at an election called by City Council. WHEREAS, Wheat Ridge City Council has adopted Ordinance No. 816, approval of a Franchise in favor of Public Service Company of Colorado, subject to approval by electors of the City of Wheat Ridge. WHEREAS, Section 2.2 of the Wheat Ridge Home Rule Charter provides that a Special Election may be called by a Resolution of City Council at least 60 Days in advance of such election. WHEREAS, The City Council wishes to call a Special Municipal Election for purpose of submitting the question of approval of said Public Service Company Franchise to the electors of the City of Wheat Ridge. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Wheat Ridge, Colorado: 1. A Special Election is hereby called, said and established for February 13, 1990 at which time the Electors of the City of Wheat Ridge shall be asked to vote on the following question: SHOULD THE PROPOSED FRANCHISE OF 20 YEARS DURATION BE GRANTED TO PUBLIC SERVICE COMPANY OF COLORADO UPON TERMS AND CONDITIONS SET FORTH IN ORDINANCE 816 SERIES OF 1989? YES NO ----------~--- 2. Said election shall be conducted according to and in compliance with the Provision of the Colorado Municipal Election Code. 3.
