RESOLUTION NO. 1199

TITLE:
A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT
BETWEEN THE CITY OF WHEAT RIDGE AND THE WHEAT RIDGE FIRE
PROTECTION DISTRICT.
WHEREAS, Section 14.2 of
City of Wheat Ridge authorizes

WHEREAS, the City of Wheat Ridge, operating pursuant to
Article XX of the Colorado Constitution and thereunder provides
emergency services to their ci ti zens, and the Wheat Ridge Fire
Protection District as defined by C.R.S., Section 32-1-103 and
operating pursuant to C.R.S., Section 32-1-1002; and
WHEREAS,
to foster better
communications; and
it is in the best interest of each participant
working relationships and insure positive
WHEREAS, it is the desire of the participants to develop
interactive and backup radio communications systems for the use and
operation of each participant; and
WHEREAS, the City Council of the City of Wheat Ridge
wishes to approve said Intergovernmental Agreement.
NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of Wheat Ridge, that
1. The Agreement attached hereto dated May 14, 1990,
between the Wheat Ridge Fire Protection District and the City of
Wheat Ridge, is hereby adopted and approved.
2. The Mayor and the City Clerk are hereby authorized
and directed to execute said Intergovernmental Agreement.

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT, is made by and between the City of Wheat Ridge, a
Municipal Corporation, and the Wheat Ridge Fire Protection
District, a Special District, hereinafter referred to as
"PARTICIPANTS' , whose authorized representatives have executed this
agreement.
WHEREAS, the City of Wheat Ridge is a Home Rule Municipal
Corporation organized and operating pursuant to Article XX of the
Colorado Constitution and thereunder provides certain emergency
services, i.e. police protection to their citizens; and the Wheat
Ridge Fire Protection Di~trict is a fire protection district as
defined by C.R.S., Section 32-1-103 and operating pursuant to
C.R.S., Section 32-1-1002; and
WHEREAS, it is in the best interest of each participant to foster
better working relationships and insure positive communications;
and
WHEREAS, it is the desire of the participants
interactive and back-up radio communications systems
and operation of each participant; and
to develop

WIIERF..AS, governmental entities are authorized by the Colorado
Constitution, Article XIV, Section 18 and Colorado Revised
Statutes, Section 29-1-201 et sea. to enter into cooperative
agreements to provide to each other any function, service, or
facility lawfully authorized to each of them and;
WHEREAS, the governing bodies of the PARTICIPANTS foster
cooperative ventures between the PARTICIPANTS whenever feasible to
better serve their respective constituencies who expect cost
effective and reliable emergency services.
1. Each PARTICIPANT will allow the other access to buildings
and property owned now and in the future for the express
purpose of installing and maintaining radio equipment to
include but not be limited to; transmitters, voting
receivers and antenna.
2. Each PARTICIPANT shall be responsible for insuring that
their equipment does not interfere with the others
operation or radio frequencies. All reasonable means
shall be taken to abate an interference issue, to include
removal of the offending equipment if necessary.

3. Each PARTICIPANT agrees to bear the associated expenses
of installation and maintenance of their individually
owned radio equipment.
IN WITNESS WHEREOF, the PARTICIPANTS hereto enter into this
INTERGOVERNMENTAL AGREEMENT providing for cooperation in the
provision of Emergency Services. Each person executing this
AGREEMENT represents and' warrants that he or she has been duly
authorized under applicable law to enter into this AGREEMENT on
behalf of the party represented by him or her.
