SERIES OF 1991
TITLE:
A RESOLUTION OF THE CITY OF WHEAT RIDGE AUTHORIZING
JEFFERSON COUNTY OPEN SPACE TO ACCEPT THE OWNER'S
APPRAISAL ON, AND TO CONTRACT FOR THE ACQUISITION OF, THE
PROPERTY LOCATED AT 4220 KIPLING STREET, WHEAT RIDGE,
COLORADO, AND FURTHER AUTHORIZING ACQUISITION OF SAID
PROPERTY FOR AN AMOUNT NOT TO EXCEED $70,104.00, AND
AUTHORIZING JEFFERSON COUNTY OPEN SPACE TO TAKE ANY AND
ALL ACTIONS NECESSARY TO COMPLETE THE LEGAL REQUIREMENTS
TO PURCHASE SAID PROPERTY.
WHEREAS, the city Council of the city of Wheat Ridge has
previously authorized Jefferson County Open Space to undertake an
appraisal, for possible purchase, of the property located at
4220 Kipling Street, Wheat Ridge, Colorado, said purchase to be
utilized for Open Space purposes;
WHEREAS, a professional appraisal was undertaken by Jefferson
county Open Space, which made an offer to purchase said property
from the owner for the amount of said appraisal, being $68,500.00;
WHEREAS, the owner, exercising his lawful rights, commissioned
an appraisal to be undertaken for the benefit of the owner, which
appraisal determined the fair market value of the property to be
$70,104.00;
WHEREAS, it is the desire of the City Council of the City of
Wheat Ridge to authorize Jefferson County Open Space to contract
with the owner for purchase of, and to purchase, owner's property
for an amount not to exceed the amount of the owner's appraisal;
WHEREAS, it is the intent of the City Council of the City of
Wheat Ridge to have said purchase completed utilizing funds within
the city of Wheat Ridge's attributable share of the Jefferson
County Open Space Fund;
WHEREAS, it is the desire of the city Council of the City of
Wheat Ridge to authorize Jefferson county Open Space to take all
actions necessary to effect said purchase as provided herein.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Wheat Ridge, Colorado, as follows:
1. The City Council of the city of Wheat Ridge hereby
authorizes Jefferson County Open Space to contract for, and
purchase, the property situate at 4220 Kipling street, Wheat Ridge,
Colorado, for an amount not to exceed $70,104.00.
2. The Mayor, the City Clerk, and City Attorney are
authorized to aid Jefferson County Open Space in any manner
required by Jefferson County Open Space, including, without
limitation, the execution of contracts, closing documents, or other
legal requirements, necessary to effect the purchase authorized
herein.
3. The purchase authorized herein shall be accomplished,
to the amount authorized in paragraph 1 hereof, utilizing a portion
of the city of Wheat Ridge's attributable share of the Jefferson
County Open Space Fund.
