SERIES OF 1991
TITLE:
A RESOLUTION OF THE CITY OF WHEAT RIDGE AMENDING
RESOLUTION NO. 1267, SERIES OF 1991, BY AUTHORIZING AN
ADDITIONAL AMOUNT, NOT TO EXCEED $1,800.00, TO ACQUIRE
THE PROPERTY, AND ATTENDANT WATER RIGHTS, AT 4220 KIPLING
STREET, WHEAT RIDGE, COLORADO.
WHEREAS, the city Council of the city of Wheat Ridge adopted
Resolution No. 1267, Series of 1991, on October 14, 1991,
authorizing the acquisition of property located at 4220 Kipling
Street, Wheat Ridge, Colorado, for an amount not to exceed
$70,104.00;
WHEREAS, Jefferson County Open Space, as agent for the city
of Wheat Ridge, tendered said offer to the owner of said property,
who accepted said offer subject to the requirement that the owner
did not agree to pay the costs of procuring a title insurance
policy at the time of said sale;
WHEREAS, subsequent to the adoption of said Resolution
No. 1267, it has come to the attention of the city that one inch
of water on the Oulette Ditch, which water right serves the
property in question, may be acquired for the amount of $1,200.00;
WHEREAS, the city wishes to authorize the expenditure of an
additional amount not to exceed $1,800.00, in addition to the
amount previously authorized in Resolution No. 1267, to purchase
the property at 4220 Kipling Street, inCluding paying the costs of
a title insurance policy and the amounts necessary to acquire the
one inch of water rights described above.
NOW, THEREFORE, BE IT RESOLVED by the city Council of the city
of Wheat Ridge, Colorado, as follows:
1. The city Council of the City of Wheat Ridge does hereby
authorize the additional expenditure of an amount not to exceed
$1,800.00 (an amount not to exceed $600.00 for a title policy, and
an amount not to exceed $1,200.00 for acquisition of one inch of
water rights on the Ou1ette Ditch) in addition to the amounts
authorized in Resolution No. 1267, Series of 1991, all for the
purpose of acquiring the property at 4220 Kipling Street, Wheat
Ridge, Colorado.
2. In all other respects, except as amended herein,
Resolution No. 1267, Series of 1991, is hereby affirmed.
