SERIES OF 1992
TITLE:
A RESOLUTION OF THE CITY OF WHEAT RIDGE AUTHORIZING
JEFFERSON COUNTY OPEN SPACE TO NEGOTIATE FOR THE
ACQUISITION OF AND TO ACQUIRE APPROXIMATELY 3.8
ACRES OF LAND LOCATED NORTH OF 35TH AVENUE BETWEEN
EVERETT STREET AND FLOWER STREET TO INCLUDE UP TO
FOUR INCHES OF WATER IN THE ROCKY MOUNTAIN DITCH AT
A COST NOT TO EXCEED THE APPRAISED VALUE.
WHEREAS, the City council of the City of Wheat Ridge has
previously authorized Jefferson County Open Space to secure an
appraisal and title commitment and survey for the acquisition of
approximately 2.25 acres of land located north of 35th Avenue
between Everett Street and Flower Street, Wheat Ridge, CO. Said
purchase to be utilized for Open Space purposes;
WHEREAS, the City Council desires to authorize Jefferson
County Open Space to acquire 3.8 acres more or less of land and up
to four inches of water in the Rocky Mountain Ditch at this site;
WHEREAS, a professional appraisal was secured by Jefferson
County Open Space, the results of which were made known to the City
Council;
WHEREAS, it is the intent of the City Council of the city of
Wheat Ridge to have said purchase completed utilizing funds within
the City of Wheat Ridge's attributable share of the Jefferson
County Open Space Fund;
WHEREAS, it is the desire of the City Council of the city of
Wheat Ridge to authorize Jefferson County Open Space to take all
action necessary to effect said purchase as provided herein;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Wheat Ridge, Colorado as follow:
1. The city Council of the City of Wheat Ridge hereby
authorizes Jefferson County Open Space to negotiate for and to
contract for the purchase of approximately 3.8 acres of land
located north of 35th Avenue between Everett street and Flower
Street, Wheat Ridge, CO., and four inches of water in the Rocky
Mountain Ditch for an amount not to exceed the cost as determined
in the appraisal dated January 17, 1992.
2. The Mayor, the city Clerk and city Attorney are
authorized to aid Jefferson County Open Space in any manor required
by Jefferson County Open Space, including, without limitation, the
execution of contracts, closing documents or other legal
requirements necessary to effect the purchase authorized herein.
3. The purchase authorized herein shall be accomplished to
the amount authorized in paragraph 1 hereof, utilizing a portion of
the City of Wheat Ridge's attributable share of the Jefferson
County Open Space Fund.
