HomeMy WebLinkAboutResolution-1992-1296 RESOLUTION NO. 1296 SERIES OF 1992 TITLE: A RESOLUTION OF THE CITY OF WHEAT RIDGE ADOPTED PURSUANT TO THE REQUIREMENTS OF COLO. REV. STAT. 16-13-702(2) AS REQUIRED IN SB 92-204, APPOINTING A COMMITTEE TO DETERMINE THE DISPOSITION OF FORFEITED PROPERTY AND PROCEEDS. WHEREAS, the Colorado General Assembly has adopted, and the Governor has signed into law, Senate Bill 92-204 which legislation, among other things, provides the framework by which political subdivisions may determine the disposition of property or proceeds forfeited pursuant to law; WHEREAS, section 16-13-702, as enacted in said Senate Bill 92- 204, requires that a committee within each seizing agency "shall, at a minimum, include the district attorney of the judicial district having jurisdiction over the forfeited property, or a designee of such district attorney; the head of the seizing agency, or the designee of such person; and a representative of the governmental body having budgetary authority over the seizing agency appointed by the governmental body"; WHEREAS, the City Council of the City of Wheat Ridge wishes to appoint a committee as described above for the purposes of entitling the City of Wheat Ridge to dispose of forfeited property in the manner set forth in said Senate Bill 92-204 and other applicable Colorado law; NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Wheat Ridge, Colorado as follows: A committee is hereby created and formed, which committee shall determine the disposition of forfeited property or proceeds thereof as provided by law. The members of said committee shall be: 1. The District Attorney of the First Judicial District, or his designee; 2. The Chief of Police of the city of Wheat Ridge, or his designee; and 3. A member of the City Council who shall be nominated by the Mayor and confirmed by the members of the City Council. The term of each committee member shall coincide with each city council term, to wit commencing on the first Monday following the regular municipal election of each odd numbered November, and terminating on the date of the succeeding election.
