TITLE:
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO SIGN
THE AGREEMENT FOR PURCHASE AND SALE, THE AGREEMENT FOR
CONSTRUCTION AND MAINTENANCE OF A COMMON BOUNDARY LINE
FENCE, AND AUTHORIZE JEFFERSON COUNTY OPEN SPACE TO
ACQUIRE THE EASTERLY 2.705 ACRES OF PROPERTY INCLUDING
WATER RIGHTS LOCATED AT 4300 TABOR IN WHEAT RIDGE.
WHEREAS, the City of Wheat Ridge City Council passed
Resolution No. 1337 series 1993 authorizing Jefferson County Open
Space to secure an appraisal, survey, ti tle commitment,
environmental hazard assessment, and negotiate the fair market
value of the easterly 2.7 acres of property located at 4300 Tabor
Street; and
WHEREAS, Jefferson County Open Space has completed the
negotiations to determine the fair market value; and
WHEREAS, the City of Wheat Ridge City Council desires to
acquire the easterly 2.705 acres at 4300 Tabor Street for parks and
recreation purposes; and
WHEREAS, the city of Wheat Ridge will construct and
maintain a boundary fence along the western edge of the acquired
property.
NOW, THEREFORE BE IT RESOLVE BY THE CITY OF WHEAT RIDGE
CITY COUNCIL THAT:
1) The Mayor and city Clerk be authorized to sign the
Agreement for Purchase and Sale. (Attachment I)
2) The Mayor and City Clerk be authorized to sign the
Agreement for Construction and Maintenance of a Common
Boundary Fence. (Attachment II)
3) Jefferson County Open Space be authorized to acquire the
easterly 2.705 acre of property located at 4300 Tabor
Street and to acquire 3 inches of water rights in the Lee
and Baugh Ditch for the negotiated price, 100% from the
city of Wheat Ridge Attributable Share of the Open Space
Fund.
DONE AND RESOLVED THIS
