TITLE:
A RESOLUTION VACATING A PERMANENT EASEMENT IN FAVOR OF
THE CITY OF WHEAT RIDGE SITUATE IN A PORTION OF THE
REAL PROPERTY OWNED BY JEFFERSON COUNTY PUBLIC SCHOOLS
GENERALLY LOCATED AT WEST 38TH AVENUE AND UPHAM STREET,
WHEAT RIDGE, COLORADO, TO JEFFERSON COUNTY PUBLIC
SCHOOLS.

WHEREAS, Jefferson County Public Schools is engaged in a / I
major structural reconstruction project involving the Wheat Ridge /,
Middle School located generally at West 38th Avenue and Upham
Street in the city of Wheat Ridge; and
WHEREAS, The ongoing reconstruction activity has required
an existing storm sewer line owned by the City to be relocated
from its existing location; and
WHEREAS, Jefferson County Public Schools has granted the
City of Wheat Ridge a new Permanent Easement for the relocated
storm sewer line; and
WHEREAS, The existing permanent easement granted to the
city of Wheat Ridge by Jefferson County Public Schools in
February 18, 1986, as recorded under Reception Number 86016711 is
no longer needed by the City; and
WHEREAS, Jefferson County Public Schools has requested the
City of Wheat Ridge vacate said Permanent Easement;
NOW THEREFORE, BE IT RESOLVED by the city Council of the
City of Wheat Ridge, that
1. The City Council of the City of Wheat Ridge does hereby
vacate the Permanent Easement as described under Reception
Number 86016711, Records of the county of Jefferson, State of
Colorado, to Jefferson County Public Schools.
2. The City of Wheat Ridge, by recording this Resolution
with the Jefferson County Clerk and Recorder, hereby grants,
conveys and returns all rights and interest accruing to the city
of Wheat Ridge under Reception Number 86016711 to Jefferson
County Public Schools.
3. A copy of this Resolution shall be recorded with the
Jefferson County Clerk wi thin 15 days of approval by the Wheat
Ridge City Council.
