SERIES 1994
TITLE:
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
SIGN THE EASEMENT AGREEMENT GRANTING THE VALLEY WATER
DISTRICT A UTILITY EASEMENT FOR THE CONSTRUCTION AND
MAINTENANCE OF A WATER LINE ACROSS THE CITY PARK LAND
OPEN SPACE PROPERTY KNOWN AS THE LOVEJOY PROPERTY
LOCATED AT 43RD AND PIERSON.
WHEREAS, R & J Associates desires to develop the land
at 11200 W. 44th Avenue into patio homesi and
WHEREAS, The Valley Water District is requiring the
construction of a loop water line as part of this developmenti
and
WHEREAS, The construction of the water line will
require crossing city park land open space known as the Lovejoy
Property located at 43rd and Piersoni and
WHEREAS, The developer has agreed to construct a 4"
chainlink fence on street frontage of tract C of the Parks ide
Patio Home Development as compensation for the easement; and
WHEREAS, The Wheat Ridge City Council desires to allow
the use of the Park land for the utility easement.
NOW, THEREFORE BE IT RESOLVED BY THE CITY OF WHEAT
RIDGE CITY COUNCIL THAT:
The Mayor and City Clerk be authorized to sign the easement
agreement granting a utility easement to the Valley Water
District for the construction and maintenance of a water line
Across the city park land open space property known as the
Lovejoy Property located at 43rd and Pierson.
