TITLE:
RESOLUTION AMENDING INTERGOVERNMENTAL AGREEMENT TO
INCLUDE THE ADDITION OF WESTMINSTER, MORRISON, AND
MOUNTAIN VIEW TO BECOME MEMBERS OF TABLE MOUNTAIN ANIMAL
CENTER
WHEREAS, the City of Wheat Ridge is a participant in an
intergovernmental agreement between the county of Jefferson, and
cities of Arvada, Lakewood, and Golden, to create and operate the
Table Mountain Animal Center, aka Jefferson Animal Shelter,
pursuant to section 29-1-201, C.R.S. 1973; and
WHEREAS, in order to permit the cities of westminster,
Morrison and Mountain View to become members of the Table Mountain
Animal Center, an amendment to said intergovernmental agreement has
been requested by the Board of Directors of the Table Mountain
Animal Center;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Wheat Ridge, that the following amendments to the
intergovernmental agreement are hereby authorized and approved:
1. The cities of westminster, Morrison, and Mountain
View be permitted to become members of the Table Mountain Animal
Center, a political subdivision, corporate and politic, as created
by the intergovernmental agreement, as amended;
2. That the Intergovernmental Agreement, dated March 15,
1976, and as amended thereafter, between the County of Jefferson,
cities of Arvada, Lakewood, Wheat Ridge, and Golden and hereafter
the cities of Westminster, Morrison, and Mountain View, attached
hereto, is hereby approved.

FIRST AMENDMENT
THIS FIRST AMENDMENT, dated for reference purposes only this 1st day of
Deeember, 1996, hereby is entered lIlto by and between the COUNTY OF JEFFERSON,
ST A TE OF COLORADO, a body politiC and corporate (the "County"), the CITY OF
AR V ADA, a muniCipal corporation ("Arvada"); the CITY OF LAKE WOOD, a muniCipal
corporatIOn ("Lakewood"), the CITY OF WHEAT RIDGE, a municipal corporatIon ("Wheat
Ridge"), the CITY OF GOLDEN, a municipal eorporation ("Golden"); the CITY OF
WESTMINSTER, a muniCipal eorporation ("Westmlllster"); the TOWN OF MORRISON, a
mUlllelpal corporation ("Morrison"); and the TOWN OF MOUNTAIN VIEW, a muniCIpal
eorporation ("Mountain View") (collectively, the "PartIes")
WITNESSETH:
WHEREAS, the County, Arvada, Wheat Ridge, Lakewood, Golden and Arvada entered
mto an Intergovernmental Agreement dated September 1, 1995 continull1g the Table Mountain
Anima] Center ("TMAC") to proVide a central alllma] shelter with expanded authonty lI1cludmg
the authority to proVide educational programs (the "Agreement"); and
WHEREAS, the Parties desire to have Mornson, Mountam View and Westminster added
as parties to the Intergovernmenta] Agreement; and
WHEREAS, thiS Amendment would be in the best lI1terest of all the Parties and TMAC.
NOW, THEREFORE, in consideratIOn of the mutual covenants and agreements of the
l'arlIes here1l1aner contallled, the receipt and suftielency of whleh are hereby confessed, It IS
understood and agreed as follows.
]. Part IV of the Agreement shall be amended by the addition of a new SectIOn D.
As follows:
D To become new parties to the Agreement, Morrison, Mountain View and
Westminster shall pay the followll1g initial capital costs:

Morrison, Mountain View and Westminster agree to appropriate the above
designated amounts by the ] st day of January, 1997, and shall pay said
money to the Table Mountain AnImal Center by January] 5, ] 997

2. MOITlson, Mountam View and/or Westmmster shall be deemed a party or parties
to the Agreement upon payment of their respective mitial capItal costs to the Table Mountam
Ammal Center and each entIty shall be entitled to and subject to the nghts and oblIgatIOns set
forth m the Agreement In the same manner as the original partIes on the date Said InItial capItal
cost IS reeelved by TMAC
3 Exeept as modIfied herein all other terms, provisions, and conditions of the
Agreement shall remam in full force and effect.
IN WITNESS WHEREOF, the Parties have executed thIS Intergovemmental
Agreement FIrst Amendment.
