RESOLUTION NO. 19-2003

TITLE:
A RESOLUTION SUBMITTING A PROPOSED ORDINANCE TO
THE REGISTERED ELECTORATE OF THE CITY CONCERNING
COMPENSATION FOR THE OFFICE OF CITY CLERK AND
FIXING A BALLOT TITLE FOR THE SAME
WHEREAS, the Council is authorized by Charter Section 6.3 and by CRS
Section 31-11-111 (2) to refer any proposed ordinance to a vote of the electorate;
and
WHEREAS, the Council wishes to refer Council Bill 39-2003, a proposed
ordinance prescribing compensation for the office of City Clerk, to a vote of the
electorate.
NOW, THEREFORE, BE IT RESOLVED by the Wheat Ridge City Council, that:
Section 1. Proposed Ordinance Referred. Pursuant to the authority vested
in it by Section 6.3 of the Wheat Ridge Home Rule Charter and Section 31-11-111,
CRS, the Council hereby refers Council Bill 39-2003, a proposed ordinance
prescribing compensation for the office of City Clerk, a copy of which ordinance is
attached hereto as Exhibit A and fully incorporated herein by this reference, to the
registered electors of the city at the November 4, 2003 general municipal election.
Section 2. Ballot Title Question.
Pursuant to Chapter VI of the Wheat Ridge Home Rule Charter and Section
31-11-111, CRS, the Council hereby fixes the ballot title upon the ordinance
referred by Section 1 hereof, to read as follows.
CITY OF WHEAT RIDGE QUESTION 1:
SHALL A REFERRED ORDINANCE REDUCING THE COMPENSATION
OF THE CITY CLERK FROM $37,000 PER YEAR TO $29,000 PER
YEAR FOR TERMS OF OFFICE COMMENCING ON AND AFTER
NOVEMBER 4, 2003 AND REPEALING ALL ORDINANCES OR
PORTIONS OF ORDINANCES IN CONFLICT THEREWITH BE
APPROVED BY THE ELECTORATE?
FOR THE ORDINANCE:

Section 3. Publication. This Resolution shall be published in a newspaper
of general circulation within the City of Wheat Ridge.

TITLE: AN ORDINANCE PRESCRIBING COMPENSATION FOR THE
OFFICE OF CITY CLERK FOR TERMS OF OFFICE
COMMENCING ON AND AFTER NOVEMBER 4, 2003
WHEREAS, the City Council is authorized by Charter Section 3.12 to
prescribe compensation for elected officials by ordinance, and
WHEREAS, the City Council is authorized by Charter Section 6.3 to refer any
proposed ordinance to a vote of the people; and
WHEREAS, the Council desires to submit this ordinance concerning
compensation for the office of City Clerk to the electors of the City at the
November 4, 2003 general municipal election, to be effective immediately upon
approval by the voters if so approved.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, COLORADO:
Section 1. Compensation of the City Clerk. For terms of office commencing
on and after the November 4, 2003 general municipal election, the compensation
of the City Clerk shall be $29,000 per year.
Section 2. Severability; ConflictinQ Ordinances Repealed. If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses
shall not be affected thereby. All other ordinances or parts of ordinances in conflict
with the provisions of this ordinance shall be repealed upon the effective date of
this Ordinance, if this Ordinance becomes so effective by popular vote
Section 3. Effective Date. This Ordinance shall take effect immediately
upon approval by a majority of registered voters on the same at the November 4,
2003 general municipal election In the event this Ordinance is not approved by a
majority of registered electors voting on this Ordinance at such election, this
Ordinance shall be null and void and without force or effect

INTRODUCED, READ, AND ADOPTED on first reading on this 8th day of
September, 2003, ordered published in full in a newspaper of general circulation in
the City of Wheat Ridge and referred to a vote of the electorate pursuant to
Section 6.3 of the Home Rule Charter, by motion of the City Council on a vote of
5 to 3.
